1. Acceptance of Terms

By accessing or using Ownsley ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all users including buyers, sellers, and attorneys.

2. Description of Service

Ownsley is a marketplace platform that connects sellers of rent-to-own properties with prospective buyers. Ownsley does not own any properties listed on the Platform, does not act as a real estate broker, and does not provide legal, financial, or investment advice. Ownsley is a technology platform only.

3. Marketplace Only — No Legal Advice

Ownsley is a listing marketplace only. Nothing on this Platform constitutes legal advice. Rent-to-own agreements are complex legal contracts subject to state and local laws that vary significantly. You should always consult a licensed real estate attorney in your state before entering into any rent-to-own agreement. Ownsley is not responsible for the terms, enforceability, or outcome of any agreement made between users.

4. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. Ownsley reserves the right to suspend or terminate accounts that violate these terms.

5. Listing Accuracy

Sellers are solely responsible for the accuracy, completeness, and legality of their listings. By creating a listing, you certify that all information provided is accurate and that the listing complies with all applicable laws in your state. Ownsley does not verify listing information and makes no representations about the accuracy of any listing. Buyers should independently verify all listing information before entering into any agreement.

6. Attorney Listings

Attorney listings on Ownsley are paid placements. Ownsley manually reviews bar credentials before activating attorney listings, but does not guarantee the accuracy, quality, or fitness of any attorney listed. You should independently verify any attorney's credentials, bar membership, and experience before engaging their services. Ownsley is not responsible for the services provided by any attorney listed on the Platform.

7. Prohibited Uses

You may not use Ownsley to: post false, misleading, or fraudulent listings; violate any applicable laws or regulations; harass, threaten, or harm other users; scrape, copy, or redistribute Platform content without permission; attempt to circumvent any security measures; or engage in any activity that disrupts or interferes with the Platform.

8. Intellectual Property

All content on Ownsley including but not limited to text, graphics, logos, and software is the property of Ownsley or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

Ownsley is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We make no warranties regarding the accuracy of listing information, the quality of properties listed, or the outcome of any transaction between users.

10. Limitation of Liability

To the maximum extent permitted by law, Ownsley shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses arising from rent-to-own agreements entered into through the Platform. Our total liability shall not exceed the amount you paid to Ownsley in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Ownsley and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your listings, your violation of these terms, or your violation of any third party rights.

12. Changes to Terms

Ownsley reserves the right to modify these terms at any time. We will notify users of material changes via email or prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the State of Tennessee without regard to conflict of law principles. Any disputes shall be resolved in the courts of Tennessee.
